Terms and conditions.

These Terms and Conditions ("Terms") govern the use of the website suvarnaassociates.com and the recruitment and overseas placement services of Suvarna & Associates, 20 Essali building, LJ Road, Mahim West, Mumbai - 400016 ("Company", "we", "us"). By visiting the website, submitting a CV or document, attending an interview arranged by us, or making any payment to us, you ("Candidate", "you") agree to these Terms.

1. Registration
The Company is a Recruiting Agent registered under the Emigration Act, 1983 with the Protector General of Emigrants, Ministry of External Affairs, Government of India, REG.NO. B-0962/MUM/PART/1000+/5/119/84. Our registration can be verified on emigrate.gov.in. We operate only in accordance with the Emigration Act, 1983, the Emigration Rules, 1983 and other applicable law, and nothing in these Terms permits anything prohibited by them.

2. Services
We source and screen candidates, forward CVs to foreign employers ("Employer"), arrange interviews and trade tests, communicate offers, and coordinate documentation, medical examination, attestation, accreditation, visa stamping, emigration clearance and air travel. We act as an intermediary only. Selection, employment and termination are decided solely by the Employer; visas by the authorities of the destination country; and emigration clearance by the Government of India. We may decline to process any application at our discretion.

3. No Guarantee
Registration, CV submission, shortlisting or interview does not guarantee selection, an offer, a visa, emigration clearance, deployment or continued employment. Job details we share are indicative and based on information from the Employer; only the signed employment contract is binding. Timelines are estimates, and we are not responsible for delays caused by Employers, embassies, authorities, medical centres, portals or airlines.

4. Candidate Obligations
You must be at least 18 years of age (or any higher age required by law or the Employer) and hold or be eligible for a valid Indian passport. You agree to provide true, complete and current information and genuine documents; attend all appointments on time; disclose any prior deportation, travel ban, visa refusal, absconding case or pending criminal proceeding; read and understand your employment contract before signing; comply with the laws of India and the destination country. Any amount paid to a sub-agent, middleman or any person other than the Company or an official authority or service provider is at your own risk and will not be refunded by us.

5. Documents and Misrepresentation
We and the Employer may verify any information or document you provide with the issuing body or previous employer. If any information or document is found to be false, forged, altered or misleading, at any stage including after deployment, we may stop processing, withdraw your candidature, inform the Employer and report the matter to the authorities, no refund will be due, and you will be liable for resulting losses under Clause 15. We take reasonable care of original documents in our custody but are not liable for loss or delay while documents are with an embassy, authority, courier or other third party. We hold your passport only for the period required for visa or emigration processing, against your written acknowledgement.

6. Service Charge
We do not charge any fee for registration, CV submission or interviews. For certain Employers the recruitment cost is borne by the Employer and no service charge is payable by the Candidate. For other Employers, a service charge is levied on the Candidate. Whether a service charge applies, and its amount, will be informed to you in writing before any payment. The service charge is payable only after you are selected and have accepted the offer.

7. Air Ticket
Where a service charge is payable, it includes a one-way economy class air ticket from an Indian airport designated by us to the city of employment, booked by the Company. The airline, route, date and time are decided by us in coordination with the Employer. Where the Employer provides the ticket, this will be stated in writing and you will not be charged twice. Travel to the departure airport, excess baggage, and any rescheduling, cancellation, no-show or re-booking charges caused by you are at your cost. We are not liable for delays, cancellations or baggage issues caused by airlines.

8. Visa and Processing Costs
Unless the Employer has agreed in writing to bear them, or the law requires the Employer to bear them, all visa and emigration processing costs are borne by the Candidate. These include passport issuance or renewal; medical examination (such as GAMCA / Wafid) and re-tests; police clearance certificate; attestation and apostille of certificates; Mosadaqa, SCE or other professional accreditation and skill verification; biometrics and visa application centre charges (such as Tasheer / VFS); visa stamping; eMigrate emigration clearance; Pravasi Bharatiya Bima Yojana insurance; and translation and courier charges. These are paid at actual cost to the relevant authority or provider, without any margin from us, and are non-refundable once paid. Government and third-party fees may change without notice.

9. Refunds
If deployment does not happen because the Employer withdraws the offer, or the visa or emigration clearance is refused for a reason not attributable to you, or you are declared medically unfit, the service charge will be refunded less any non-recoverable air ticket charges already incurred. If you withdraw, refuse to travel or fail to join without valid reason after paying the service charge, we may retain the ticket cost and cancellation charges plus up to 50% of the service charge before visa issuance, or up to the full service charge after visa issuance. No refund is due where processing stops because of misrepresentation, false documents, non-disclosure, misconduct or breach of these Terms. After deployment, the service charge is fully earned and non-refundable. Refund requests must be made in writing with the original receipt; approved refunds are paid within 30 days to an account in your own name.

10. Employment and After Deployment
Your employment is governed by your contract with the Employer and the labour laws of the destination country. The Company is not your employer and is not a party to that contract. Salary, benefits, accommodation, working conditions and treatment are the Employer's responsibility. You must not abscond, take up unauthorised employment or overstay. We are not responsible for your acts after deployment or for the Employer's acts, but if you face non-payment of wages, contract substitution or ill-treatment, inform us immediately and we will take it up with the Employer and assist you in approaching the Indian Embassy or Consulate. Nothing here limits any obligation we have under the Emigration Act, 1983.

11. Employers and Clients
Services to Employers are governed by a separate written agreement, demand letter and power of attorney. Employers warrant that requirements are genuine, that they are legally permitted to employ foreign workers, and that workers will be employed as per the approved terms and local law. Candidate information is confidential and may be used only for the stated requirement. An Employer may not hire any candidate introduced by us, directly or through another agency, within [12] months of introduction without paying our agreed fee.

12. Personal Data
We process personal data in accordance with the Digital Personal Data Protection Act, 2023. By submitting your information you consent to us collecting, storing and using it (including CV, contact details, photographs, passport and identity details, certificates and medical results) for our services, and sharing it with prospective Employers (including outside India), embassies, government authorities including eMigrate, medical centres, attestation and accreditation bodies, visa centres, airlines and insurers. We do not sell personal data. Data is retained as long as needed for our services and legal record-keeping. You may request access, correction or erasure, or withdraw consent, by writing to the Grievance Officer; withdrawal may mean we can no longer process your application. You consent to receive calls, SMS, emails and WhatsApp messages from us regarding jobs and your application.

13. Website
All website content, logos and design belong to the Company. You may not copy, republish, scrape or misuse it, or use our name or logo without written permission. The website and its content are provided "as is"; information on visa and emigration procedures is general guidance, not legal advice. We are not responsible for third-party websites linked from ours.

14. Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for any indirect, incidental or consequential loss, including loss of expected earnings, opportunity or employment, and our total liability to any Candidate shall not exceed the service charge actually paid by that Candidate. Nothing in these Terms limits liability that cannot be limited by law, including for fraud, wilful misconduct, or under the Emigration Act, 1983 or the Consumer Protection Act, 2019.

15. Indemnity
You agree to indemnify the Company, its partners, directors, employees and agents against all claims, losses, penalties and reasonable costs, including legal fees, arising from any false or forged information or document you provide, your breach of these Terms, or your breach of law.

16. Force Majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, war, conflict, civil unrest, flight suspensions, airspace closures, suspension or change of visa issuance, changes in labour or localisation policies of the destination country, government action or failure of government portals. If such an event prevents deployment for more than [90] days, either party may cancel by written notice and Clause 9 will apply to refunds.

17. Grievances, Governing Law and Jurisdiction
Complaints may be sent to info@suvarnaassociates.com. We will acknowledge within 2 working days and aim to resolve within 15 days. This does not prevent you from approaching the Protector of Emigrants, the eMigrate or MADAD portals, the Indian Embassy or Consulate, or any consumer forum or court. These Terms are governed by the laws of India and, subject to the foregoing, the courts have exclusive jurisdiction.

18. General
We may update these Terms by publishing a revised version on this page; updates do not affect fee or refund terms already confirmed to you in writing. If any provision is held invalid, the rest remain in effect. No delay in enforcing a right is a waiver of it. You may not transfer your rights under these Terms. No verbal promise about employment, salary or fees binds the Company unless confirmed in writing. If these Terms are explained in another language, the English version prevails.

Made for hiring. Made for careers. Made for you.
